Construction RunoffAll local governments must obtain coverage under the TPDES Construction General Permit for any municipal construction activities that disturb one or more acres (or collectively disturb one or more acres under a common plan of development).

Signature Requirements in 30 TAC §305.44 for Water Quality Authorizations (6/04) [PDF]
This document reiterates and clarifies the requirements spelled out in 30 TAC 305.44:

  • For a municipality, the signatory must be the ranking elected official or principal executive officer.
  • If a municipality wants to use the principal executive officer, the city or county must make sure that position is identified in the city charter, county or city ordinances, or unter the Texas statute(s) under which the governmental entity was formed.
  • Signatory responsibility may not be delegated to a government representative other than the ranking elected official or principal executive officer.
