Solid Waste Facility Permit Review and Comments of Applications for Conformance with the Regional Plan

In accordance with §363.066 of the Texas Health and Safety Code, municipal solid waste (MSW) regulatory activities must conform to adopted regional and local solid waste management plans. In the North Central Texas region, the North Central Texas Council of Governments (NCTCOG) is the regional solid waste planning agency designated by the Texas Commission on Environmental Quality (TCEQ), through the Regional Solid Waste Grants Program, to conduct conformance reviews of MSW facility permit and registration applications. TCEQ considers NCTCOG's review and comments of a facility's conformance or non-conformance in the approval process.

Currently, the NCTCOG Assuring Capacity for Trash (ACT) Subcommittee of the Resource Conservation Council (RCC) is the regional solid waste advisory committee charged with conducting conformance reviews for solid waste facilities and making the recommendation to the RCC. The RCC then votes to accept the recommendation of the ACT subcommittee and the outcome is then forwarded to the applicant and TCEQ.

As stated previously, TCEQ requires that MSW regulatory activities must conform to adopted regional and local solid waste management plans. All solid waste facilities must demonstrate conformance to the current adopted regional plan, The Regional Solid Waste Management Plan for North Central Texas. Under this regional plan, applicants should demonstrate how their facility would advance the following goals:

  1. Minimizing Household Trash
  2. Minimizing Apartment and Commercial Trash
  3. Expanding Recycling Markets
  4. Assuring Treatment and Disposal Capacity
  5. Stopping Illegal Dumping
  6. Coordinating State, Local, and Regional Solid Waste Management

Pre-Meeting Requirements:

If you have a proposed or existing facility that is required to go through the conformance review process, you should notify the appropriate NCTCOG staff at least one (1) month prior to the subcommittee meeting at which you wish to present and your equipment needs*. You will also need to provide the following items to NCTCOG staff two (2) weeks prior to the subcommittee meeting (see subcommittee meeting schedule):

  1. Conformance review request letter,
  2. Fifteen (15) printed copies of the completed Review Form provided by NCTCOG,
  3. Fifteen (15) printed copies of your presentation,
  4. The presentation, Review Form and request letter on CD-ROM (submit in PDF format),
  5. Any additional handouts you intend to provide to subcommittee members

*If available, NCTCOG can provide a laptop, projector, and screen for your presentation. Arrangements for equipment should be made at the one (1) month notification time.
